House Passes Medical Liability Reform - Again

The House voted 229-197 to approve H.R. 4280, which would cap noneconomic/pain and suffering damage awards at $250,000 in medical liability suits; provide for unlimited economic recoveries in such cases; and limit punitive damages to $250,000, or double the amount of economic damages awarded, whichever is greater. The House passed a similar provision (HR 5) in March 2003. It is estimated the House will combine this bill with several other healthcare measures before sending it to the Senate in an effort to get the issue of medical liability reform moving in the chamber.
